Yes, because I can bet that these seats were purchased brand new.
The health department has strict codes for sanitary restaurants and they would definitely not let a "used" toilet be used.

That would be pretty funny... actually! I think the restaurant would have a fun theme... but it wouldn't be a great place for a date or anything. But funny, yes. HELL NO ITS A TOLIET not a very clean image while your are eating
