I suggest you contact your local Community College. Most offer classes on how to start your own business. And there is a ton of information and things to consider. The general rule of thumb for opening your own business is not to expect to see a profit for two years. And you need to have the capitol, etc...to get you through that. As to your questions about the legalities. That all depends on not only your state laws but your city requirements also. Good Luck.

tell some pepz and put signs up and then when it comes to the store opining open it up and do something or have sumthing that will atract pepz to the restraunt
I usually open my restaurants with a key.
Paperwork, Legal documents, hiring builders, architects, what is wrong with you? I don't know where you live at, but I'm pretty sure you can find a building for rent that was once a restaurant. If you can't well then it's not meant for you to have one.
