In TX, if it is bought in leaf form, it is considered a food item and non-taxable. If it is bought in a liquid form in a container or served at a restaurant or any place that serves prepared food ready to eat, it is taxable.
Depends on what state you live in. I live in TX and we pay no sales tax on grocery items. I don't think that is the answer you were looking for, but thats the answer I had :)

it is a food product and there is no tax on it when you buy it in the store. i am sure there is a tax on the materials imported to make it
